S.B. 328 expanded the power of police to draw warrantless blood tests on DWI suspects. This bill proposed a conflict amongst numerous health care professionals. Many of them had to be convinced to assist law enforcement with the procedure of drawing blood on an individual who had refused for this procedure to be done. Some professionals have gone as far as to refuse to draw blood samples even with court orders due to many concerns being raised about the liability matter and the potential infringement of the Hippocratic Oath. The bill provides that the taking of a specimen from a person who objects or resists doe not in itself constitute negligence, however this does not translate to immunity from liability for negligence in taking a blood specimen.
