Assessment on Driver’s License Numbers on Sales Receipt

H.B. 523 which goes into effect on January 1, 2010, amends two sections in Chapter 501 of the TBCC to ban the printing or distributing of an individuals driver’s license number on a receipt or legal document that shows evidence of compensation towards the sale of goods and/or services and is provided to that entity. Individuals who violate this law may be accountable to the state for a civil penalty of up to $500 on a monthly basis in accordance with the violation. If more than one violation occurs in a month, the civil penalty cannot be forced upon the individual for more than one violation. The penalty is a one time occurrence based on a monthly basis. Through this bill, only an attorney or county prosecuting attorney is approved to bring an action to recover the civil penalty at hand.
